General contract terms

1-liability clause.

COLOMBIA SURF TRAVEL is covered by the protection law and regulations contained in Law 679 of 2001 on legal and criminal consequences for exploitation and sexual abuse of minors, CST has no interference against operation by carriers regardless of the mode of transport; consequently, the carrier shall be responsible for the air transport service. This except in the case of a charter flight according to contracting conditions of transport.

2- KNOWLEDGE AND ACCEPTANCE OF THE TERMS.

The client acknowledges and accepts the general conditions of the program, package or excursion he is getting, according to information provided by CST. In witness whereof, the customer signs this document and makes the corresponding deposit. According to the destination(s) of the program, CST deliver information to be considered by the traveler in the different stages of the journey. This is to help the traveler and is not an obligation or commitment by CST.

3- CHANGES IN THE SCHEDULE AND LIMITATION OF LIABILITY.

The organizers of the trip may make changes to the schedule due to unforeseen events in the itinerary, whether by air, land, maritime, which are the result of a situation of force majeure or fortuitous. CST is not responsible for delays, cancellations or difficulties caused by accidents, strikes or natural phenomena such as earthquakes, hurricanes, tidal waves, snow, cyclones, tornadoes, landslides, avalanches, etc. As well as mechanical and meteorological difficulties requiring service providers to make cancellations or changes in itineraries or routes. Also CST is not responsible for incidents that may occur within establishments and / or hotels, hostels, camping sites, used in the itinerary of the trip.

4- DEPOSITS AND PAYMENT DATES.

To guarantee the reservation it is essential that the person acquiring the goods / services, make a deposit corresponding to 50% FIFTY PERCENT, of the total package price, this value will be paid as installment to the full amount, as long as it is made 90 days prior to the departure schedule of the trip. Between 30 and 15 days prior to the departure schedule, the traveler will have to have paid ONE HUNDRED PERCENT 100% of the total cost of the program, package etc., including taxes and additional surcharges and other variable costs that apply.

5- CANCELLATIONS AND RETURNS.

CST reserves the right to cancel the program, plan or package, or to charge a fee for their rendering of a private service in the case of not reaching the number of participants that are required for the same, if a force majeure circumstance occurs or in general, when CST decides it is not doable. In these cases the traveler is entitled to a refund of the amount paid so far. If CST offers an alternative date next, the value paid by the passenger can be applied to this next alternative, provided that there is prior consent. In accordance with Article 65 of Law 300 of 1996, CST may retain the deposit received from the customer or require a percentage of the total value of the trip, according to the following situations:

  • A- If the cancellation is made within 90 DAYS prior to the departure schedule of the trip, CST will retain 10% TEN PERCENT of the subscriber value, except in those cases where the passenger wants to keep the deposit to travel on another occasion within a maximum period of 12 MONTHS, starting from the date of payment of the deposit.
  • B- If the cancellation is made within 89 to 30 DAYS prior to the departure schedule, CST will retain 20% TWENTY PERCENT of the total amount paid.
  • C- If the cancellation is made within 20 and 15 DAYS prior to the departure schedule, CST will retain 50% FIFTY PERCENT of the total amount paid.
  • D- If the cancellation is made within 14 DAYS prior to the departure schedule, CST will retain 100% ONE HUNDRED PERCENT of the amount.

NOTE: Once the trip starts, if the passenger for any reason of force majeure like disease, whim or disgust, has to return home, the operator is not responsible for the extra costs to return to their country or city of origin, and should bear the extra costs for route and / or date modifications as applicable, no installments will be refunded. CST will reinstate the values that may apply as detailed above, provided that the complaints are received in writing and may be applicable in accordance with the contractual policies defined by COLOMBIA SURF TRAVEL. Refunds and returns will be done 45 calendar days subsequent to the formal receipt of the complaint. This is done if and when the service provider has reimbursed the corresponding values.

6- VISAS AND TRAVEL DOCUMENTS.

In cases where the denial or delay in applying for visas or passports, or failure in any requirement previously informed to the tourist or traveler and these prevent him from traveling, the implementation as contemplated in the cancellations clause will be done. The immigration authorities of countries to visit, hold the right to allow entry or exit of tourists, so CST is not responsible for their entry or exit to the different countries. If it were the case, the passenger is liable for costs that may apply.

7- SANCTIONS.

CST reserves the right to withdraw from the program the passenger whose behavior threatens the success of it, tranquility and integrity of their other fellow travelers. In which case, the person will cover the costs that may be required for route and / or date modifications, in addition to no refund of the amount paid for services. The passenger is responsible for his behavior during the course of the trip, as well as any issues of civil or criminal nature in which he gets involved in, so the passenger will assume in person any consequences of a situation arising, besides the costs and cancellation penalties if there are grounds for them. For this purpose the behavior will be assessed and informed to the offending traveler through a release format in the presence of several witnesses.

8- PERSONAL EFFECTS AND BAGGAGE.

The equipment allowed for each trip or excursion can change either by route or airline, excess baggage costs are not stipulated or controlled by CST, if this situation arises, the passenger will assume the costs for this concept. We are not responsible for any deterioration, damage or theft occurred during the trip. Each individual participant is fully responsible for their luggage and its contents (personal effects).

9. PERSONAL DATA.

The customer authorizes CST to store his or her business and/or personal data in its database, according to the article in Law 1581 of 2012 and Decree 1377 of 2013. This information can be accessed, managed, verified and / or updated in accordance with the policies of CST.

10- EXECUTIVE MERIT.

ALL CONTENTS OF THIS AGREEMENT ARE CLEAR, THE TOTAL OR PARTIAL BREACH WILL RESULT IN FINES AND PENALTIES BY COLOMBIA SURF TRAVEL. WITH MY SIGNATURE I DECLARE THAT I KNOW THE CONDITIONS AND RULES AND I COMPLETELY ACCEPT THEM. THE PAYMENT AND SETTLEMENT PROCESSES ARE CLEAR TO ME. I AM ALSO AWARE THAT VALUES MAY CHANGE DUE TO RATE AND CURRENCY FLUCTUATION, IATA REGULATIONS, OR EVEN TAX CHANGES OR PUBLICATION ESTABLISHED IN EACH COUNTRY.
